In the EU and the UK, customers have no 14-day right to return goods made to their specifications or clearly personalised, such as an engraved name or a monogram (Directive 2011/83/EU, Art. 16(c); UK Consumer Contracts Regulations 2013, reg 28(1)(b)). You must also tell them before they buy that the right doesn't apply (Art. 6(1)(k); CCR Sch. 2 para (o)). In the EU, UK and Australia a faulty or wrongly engraved item must still be repaired, replaced or refunded; in the US, state warranty law applies. US federal law sets no general return right at all: your posted policy and state law decide.

Below: where the line between personalised and plain sits, a table of the rules with the article behind each cell, the Shopify final-sale setup (and the trap with optional engraving), a checklist that stops typo returns before you engrave, and policy wording you can paste. This is general information, not legal advice.

What counts as personalised

EU law defines goods made to the consumer's specifications as "non-prefabricated goods made on the basis of an individual choice of or decision by the consumer" (Art. 2(4)). In practice:

  • Personalised: an engraved name or date, a monogram, text the buyer typed, a photo they uploaded. You can't resell it.
  • Not personalised: a stock ring where the buyer only picked a size, metal or colour from your standard variants. It is prefabricated, so the normal 14-day withdrawal right applies.

The Court of Justice looked at the timing question in Möbel Kraft (C-529/19, 21 October 2020), a kitchen ordered at a trade fair. As reported by Garrigues, the Court ruled that the exception applies "irrespective of whether the production or assembly of the goods has commenced". So a buyer can't cancel a made-to-spec order just because you haven't started it.

AustraliaNone: no refund needed for change of mindYour policy decides"No refunds for change of mind" is fine; a bare "no refunds" sign is not (ACCC)Consumer guarantees: acceptable quality, matches description

The UK and EU duty to tell the buyer is the part merchants skip. If the no-withdrawal notice isn't on the product page or at checkout, you are relying on an exception you were required to disclose and didn't. That breaches your information duty and weakens your position in a dispute, because the trader has to prove the information was given (Art. 6(9)). In the US, the production time matters more than the return policy: a made-to-order item that ships later than you promised triggers the FTC's delay-notice and refund rules, and Rule refunds can't be swapped for store credit (FTC).

Faulty is not changed mind

The exception only removes the change-of-mind right. If you misspelled the name, used the wrong font or the print came out blurred, the item doesn't match what was ordered. That is your error, and the buyer gets a repair, replacement or refund under EU 2019/771, the Consumer Rights Act 2015 or the Australian consumer guarantees. A typo the customer typed is different: you made what they asked for. To tell the two apart you need a record of exactly what they entered and approved.

Set it up in Shopify

Shopify can block return requests for final-sale items (Shopify Help: return and cancellation rules):

  1. Go to Settings → Policies and open your Return and cancellation rules.
  2. Click the rule, then Final sale items.
  3. Under Applies to, choose Collections or Products (not both in one list).
  4. Add the collections, products or individual product variants that are made to order.
  5. Click Add, then Save.
  6. If you sell into the EU with market-specific policies, repeat this for each market: each one has its own final-sale list.

Limits from the same page: bundles can't be final sale, customers can't submit a request for a final-sale item through Shopify, and Shopify says the tools don't by themselves make your store compliant.

The trap is optional engraving. Final sale matches a product or variant. Engraving text captured on the same variant can't be told apart, so if one ring is sold plain and engraved, you can't make only the engraved ones final sale. Fix: add an Engraved variant (or a separate engraved product) and mark that one.

With Engravelly, a paid personalization goes in the cart as its own line on a product called Personalization. Marking that product final sale covers the personalization fee, not the item itself; the engraved item stays returnable in Shopify unless you mark its product or variant too. Fees are explained in Billing.

Stop the typo return before you engrave

  • Show a live preview with the exact text and font before add to cart, so the buyer checks their own spelling (see the shopper experience).
  • Set a maximum number of characters on each text field so long names don't get shrunk or cut. The personalization text field guide covers limits and allowed characters.
  • Put a line like "Personalised items can't be returned unless faulty" next to the add-to-cart button and on your checkout policy. That is the pre-purchase disclosure the EU and UK require.
  • Put the production time on the product page, so the FTC ship-time rule works for you.
  • For high-value pieces, send the design for approval. On the Growth plan, open the design in Customer designs and use Send for approval under Customer approval. The customer gets a link to approve the design or ask for changes (the link works for 7 days), and you get their answer by email. If the design changes, the old approval no longer counts.
  • Turn on Hold production files until the customer approves the design in Settings → Production. New orders wait as "Awaiting approval" and the files are made once the customer approves (orders and production).
  • Keep the approved preview with the order. It is your evidence if a "not as described" chargeback arrives.

Policy wording to copy

Replace N with your own numbers. Have it checked for your markets if you sell a lot cross-border.

EU and UK

Items personalised to your order (engraved, monogrammed or printed with your text or image) are made to your specifications. Under EU and UK consumer law they are excluded from the 14-day right of withdrawal and cancellation, so we can't take them back if you change your mind. This doesn't affect your legal rights if an item is faulty, damaged, or not made as you ordered it (for example, our engraving doesn't match the text you approved). In that case, contact us within N days of delivery with photos and we'll repair, replace or refund it. Items that aren't personalised can be returned within 14 days of delivery.

US

Personalised items are made to order and are final sale. If your item arrives damaged, defective, or different from the design you approved, email us within N days of delivery with photos and we'll remake it or refund you. Our current production time is N business days before shipping.

In Australia, say "no refunds for change of mind", never just "no refunds". For more on engraving and jewellery setups, see engraving, custom jewelry and monograms and embroidery.

FAQ

The customer misspelled the name. Do I have to refund?

Not for change of mind, because the item matches what they entered. Whether you remake it as goodwill is your call. A preview plus an approved proof makes the question rare.

They cancelled before I engraved it.

In the EU, Möbel Kraft says the exception applies whether or not production has started. Your own policy can still be more generous, for example free cancellation until the files are made.

Can a gift recipient return it?

For a personalised item there is no change-of-mind right for anyone, buyer or recipient. A fault is different: deal with whoever contacts you, using the order record. In Australia the ACCC says people who receive a product as a gift "are entitled to the same basic rights" as if they had bought it (ACCC consumer rights).

Do I need an app to make engraved items final sale?

No. Shopify's final-sale rules do it, as long as the engraved version is its own product or variant. A personalizer adds the preview, limits and approval that keep the faulty-or-typo argument from starting. See our personalizer app comparison.
